These Terms of Use ("Terms") govern your access to and use of the complimentary Wi-Fi network provided by lynxresort ("we," "us," or "our") at our short-term rental properties in Florida. By connecting to our network and submitting your information through our captive portal, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years of age to use our Wi-Fi service and submit your personal information through this portal. By using the service, you represent that you are 18 or older.
2. Permitted Use
Our Wi-Fi is provided as a complimentary amenity for guests staying at lynxresort properties. You agree to use the network only for lawful purposes and in a manner that does not:
- Infringe on the rights of others
- Transmit spam, malware, or harmful content
- Attempt to gain unauthorized access to any system or network
- Violate any applicable federal, state, or local laws or regulations
- Interfere with the network's operation or other guests' use of the service
3. No Guarantee of Service
We provide Wi-Fi access on an "as is" and "as available" basis. We make no warranties or representations regarding the speed, reliability, or uninterrupted availability of the service. We reserve the right to modify, suspend, or discontinue access at any time without notice.
4. Data Collection and Marketing
By submitting your information through this portal, you acknowledge that we collect personal data as described in our Privacy Policy. If you checked the opt-in boxes during sign-up, you consent to receiving promotional emails and/or SMS messages from lynxresort about offers, upcoming availability, and events. You may withdraw this consent at any time by contacting us at support@lynxresort.com or clicking "Unsubscribe" in any communication.
5. Session Duration and Re-Authentication
Your authorized Wi-Fi session will remain active for a defined period (typically 7 days from your initial sign-in). After expiration, you may be required to re-authenticate by submitting your information again through this portal.
6. Privacy
Your use of this service is subject to our Privacy Policy, which is incorporated by reference into these Terms. Please review it carefully to understand how we collect, use, and protect your information.
7. Disclaimer of Warranties
To the fullest extent permitted by applicable law, lynxresort disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free, secure, or free of viruses or other harmful components.
8. Limitation of Liability
To the fullest extent permitted by law, lynxresort shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Wi-Fi service, including but not limited to loss of data, loss of privacy, or damage to your device.
9. Indemnification
You agree to indemnify, defend, and hold harmless lynxresort and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Wi-Fi service or violation of these Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Florida.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted at this URL with a revised effective date. Your continued use of our Wi-Fi service after any changes constitutes acceptance of the updated Terms.
